These Terms of Service (“Terms”) govern your access to and use of the buildarity.com website, our agency services (full-stack development, AI solutions, SaaS & tool development, media production, design & branding, and SEO & marketing), and the software tools made available under /tools/ (collectively, the “Services”), operated by Buildarity (“Buildarity,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Who We Are
Buildarity is a technology and digital services studio providing custom development, AI, SaaS & software tools, media, design, and marketing services, alongside a set of standalone web-based tools.
The Services are operated by Buildarity LTD, a company registered in England & Wales under company number 17408467 (registered office: Office 20690, 182-184 High Street North, East Ham, London, United Kingdom, E6 2JA). You can verify this registration on the UK Companies House register at find-and-update.company-information.service.gov.uk. Certain development and support operations are carried out through our Egypt branch, Buildarity for Software Development LTD, operating under Buildarity LTD.
2. Description of Services
Services offered through this site fall into two broad categories:
- Agency Services — custom, quoted project work (e.g. software development, AI solutions, SaaS & tool development, media production, branding/design, and SEO/marketing) requested via our quote form and confirmed separately in writing (proposal, invoice, or contract).
- Tools — self-serve web applications listed under /tools/, some of which are free and some of which may require a paid plan or one-time purchase.
3. Accounts & Registration
Certain tools may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Fees, Payments & Subscriptions
Paid agency work is billed according to the proposal or invoice you accept. Paid tools may be billed as a one-time purchase or a recurring subscription, as shown at checkout. Card payments (including Apple Pay and Google Pay) are processed securely by Stripe, and cryptocurrency payments are accepted in USDT on the TRC20 and BEP20 networks; by paying, you also agree to the applicable terms of that payment provider or network. Subscriptions renew automatically at the stated interval until cancelled. You can cancel a subscription at any time; cancellation stops future billing but does not itself entitle you to a refund of amounts already charged — see our Return Policy for refund terms.
5. Acceptable Use
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to our systems or another user’s account; (c) upload malicious code or interfere with the Services’ normal operation; (d) reverse engineer, resell, or scrape the tools without our written permission; or (e) use the Services to generate, host, or distribute content that infringes third-party rights or violates applicable law.
6. Intellectual Property
Unless otherwise agreed in a signed proposal or contract, Buildarity retains ownership of its underlying platforms, tools, source code, designs, and pre-existing materials. For custom agency work, ownership of client-specific deliverables transfers as specified in the applicable proposal/contract, generally upon full payment. You retain ownership of content and data you upload to our tools.
7. Third-Party Services
The Services may integrate with or link to third-party platforms (including social media platforms, payment processors, and APIs). We are not responsible for the availability, content, or practices of third-party services, and your use of them is subject to their own terms.
8. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Buildarity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to Buildarity in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms. You may stop using the Services and/or cancel any active subscription at any time.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Buildarity is registered to do business, without regard to conflict-of-law principles, unless otherwise required by applicable local consumer protection law.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
